NOTICE OF CRIMINAL TRESPASS AND DAMAGES RESULTING


Greetings:


We have notified you of posted property at 603 S. Walnut in Cleburne, Texas.


We have notified you that you and/or your agents have committed Criminal Trespass in violation of Texas Penal Code, Sec. 30.05 at 603 S. Walnut in Cleburne, Texas. One trespass incident was investigated by the Cleburne Police Department. We chose not to sign a complaint in the hope that no further trespass would be committed. That did not happen.


The latest incident of Criminal Trespass at 603 S. Walnut in Cleburne, Texas, in violation of Texas Penal Code, Sec. 30.05 was on December 5, 2006. This time property damage resulted. Two 10' T posts and one stretcher post (2" galvanized steel pipe seated in two feet of concrete) were damaged or destroyed. All posts were painted with John Deere Green Implement Paint. These posts are part of a trellis being built for climbing roses which will provide privacy for our property. We have scheduled completion of the trellis for December 9, 2006.


This is DEMAND that these damaged posts be replaced on this date, December 6, 2006. This is necessary because the stretcher post is set in concrete which must cure three days before tension is placed on it. Any delay in repairing this damage will result in increased damage to us.


This NOTICE/DEMAND is notice and demand to the City of Cleburne and its agents and contractors.
